These Terms of Service ("Terms") govern your access to and use of the Safeside Insurance rewards platform (the "Platform") at lender.safesideins.com, operated by Safeside Insurance ("Safeside," "we," "us," or "our"). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
Eligibility
You must be at least 18 years old and an authorized employee or representative of a company that participates in the Safeside referral program. You are responsible for ensuring your use of the Platform is permitted by your employer.
The Service
The Platform allows eligible users to submit referrals of homeowners' insurance business to Safeside and to track potential rewards for referrals that Safeside approves. We may change, suspend, or discontinue any part of the Platform at any time.
Accounts
You agree to provide accurate information, keep your account credentials secure, and remain responsible for activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Referrals and Rewards
Submitting a referral does not guarantee a reward. Rewards are earned only for referrals that Safeside reviews and approves. Referrals that are pending, rejected, duplicate, incomplete, or ineligible earn no reward.
Reward amounts are determined by Safeside and may differ by company or change over time. Any change applies to referrals submitted after the change takes effect. Rewards are subject to verification, and we may withhold or reverse rewards for referrals that are fraudulent, inaccurate, duplicated, or otherwise ineligible.
You are responsible for any taxes that may apply to rewards you receive.
Referral Information and Consent
When you submit a referral, you represent that you have the right to share the information you provide, including any information about the referred individual, and that the information is accurate. You agree not to submit information you are not authorized to share.
Acceptable Use
You agree not to misuse the Platform, including by submitting false or fraudulent referrals, attempting to gain unauthorized access, interfering with the Platform's operation, or using it for any unlawful purpose.
Intellectual Property
The Platform, including its content, design, and trademarks, is owned by Safeside or its licensors and is protected by applicable laws. You may not copy, modify, or distribute it except as permitted by these Terms.
Disclaimers
The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.
Limitation of Liability
To the fullest extent permitted by law, Safeside and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Platform.
Indemnification
You agree to indemnify and hold harmless Safeside and its affiliates from any claims, losses, or expenses arising from your use of the Platform or your violation of these Terms.
Termination
We may suspend or terminate your access to the Platform at any time, with or without notice, including for violation of these Terms. Provisions that by their nature should survive termination will continue to apply.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the courts located in New York.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Platform after changes take effect means you accept the updated Terms.
